EU Data Act Notice
In todayās connected world, data plays a key role in improving services and efficiency ā especially in fleet operations and equipment management. Like many modern devices, our connected equipment can generate and transmit operational data.
Where contractually agreed, we collect such data to provide valuable, data-driven products and services that support fleet management, diagnostics, repair, and maintenance.
This notice is to inform your company, the āuserā, about the data Bromma (as part of Kalmar Corporation) collects and the userās rights under the EU Data Act (Regulation EU 2023/2854). The Act becomes applicable on 12 September 2025. To continue utilizing our data offerings, we are required to agree on the terms regarding this data with you, the user. This will take place by concluding a Data Annex, which will be an integral part of your customer agreement regarding the sale of the equipment with Bromma, and will be concluded as part of such customer agreement, or where the customer agreement has been concluded before 12 September 2025, may be concluded separately where applicable. This Data Annex will enter into force on 12 September 2025.
Data & Connected Products
Bromma spreaders are connected products that generate data continuously. This data supports a range of data-driven services, including operational monitoring, maintenance planning, and fleet management. Bromma retains ownership of the trade secrets contained within the data collected from these connected products. As listed below, these products can store data either on-device or on a remote server. Data is retained only as long as necessary for its intended purpose, but in no case longer than 10 years.
The format of the data we provide to the User is JSON.
How We Use the Data
We may use this data to:
- Fulfill our equipment sales and digital service agreements with users;
- Provide support, warranty, and guarantee services;
- Monitor and maintain the safety and security of our products and services, and ensure their quality;
- Improve the functioning of our existing products and develop new products and services.
We will not use the data to gain insights into any userās economic situation, assets, or production methods in a way that would undermine the userās commercial position.
Userās Rights
Users have the right to request that Bromma share their data with their own company or with a third party. To access and retrieve this data, or to cease data sharing with a third party, please contact your Bromma representative. Kindly note that data access will be available starting September 12, 2025.
Should a user believe their rights under the EU Data Act have been infringed, they are entitled to lodge a complaint with the competent authority (Art. 37 of the Act). We also encourage the user to contact us to facilitate a prompt good-faith resolution of the matter.
The duration and termination of our data gathering contract with you are determined by the terms of our specific agreement.
Limitations to Userās Rights
The User is not entitled to:
- Use the data to develop a connected product that competes with Bromma spreaders, nor to share the data with a third party with that intent;
- Use such data to derive insights about Brommaās economic situation, assets, and production methods;
- Use coercive means to obtain access to data or, for that purpose, abuse gaps in Brommaās technical infrastructure designed to protect the data;
- share the data with a third-party considered as a gatekeeper under the Data Act (Art. 3);
- Use the data they receive for any purposes that infringe EU law or applicable national law.

Crane Spreaders: Ship To Shore (STS), Yard and Mobile Harbour Crane (MHC)
Product Description:
Ship To Shore (STS)
The Bromma STS spreaders are used by ship-to-shore cranes, to load and offload cargo containers from container vessels.
Yard
The Bromma Yard spreaders are used by yard cranes, in order to move and remove cargo containers from the storage in the yard.
Mobile Harbour Crane (MHC)
The Bromma MHC spreaders are used by mobile or jib cranes, to load and offload cargo containers from container vessels.
Data Generation
Data Types Generated:
– Spreader usage data (work cycles, running hours, twistlock cycles etc.)
– Location data
– Errors and Events generated
Data Collection Methods:
Automatic data collection during product use, Data collection device status sent.
Estimated Volume:
Brommaās Connected Products offer various versions and customization options. The general estimated volume of the data generated in our Connected Products is highly dependent on the individual equipment parameters (including but not limited to version, equipment, type of use, modifications, and digital services). A typical volume is 20-22kB per hour during normal operations.
Data Storage
Brommaās Connected Products store data on board as well as are capable of sending data to backends, which is stored in our secure cloud servers within the EU.
